These Terms are live. They govern your purchase and use of Operator Fuel. They are not legal advice to you about your business, and Operator Fuel / James Bruchey are not your attorney.
By purchasing, downloading, installing, or using any Operator Fuel / OpFuel kit or related digital materials (the “Kit”), you (“you,” “Buyer”) agree to these Terms.
Operator Fuel (“Operator Fuel,” “OpFuel,” “we,” “us”) is operated by James Bruchey. Public contact: support@getoperatorfuel.com.
Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use the Kit solely for your internal business or personal operations, within the seat/team size you purchased (default: single purchaser / one desk, unless an Enterprise or explicit multi-seat SKU says otherwise).
You do not own the Kit. All intellectual property rights in the Kit remain with Operator Fuel / James Bruchey.
You may not:
Kits are designed for use with third-party AI and SaaS tools (e.g. Grok Bot, Cursor, Slack, GitHub). Those tools have their own terms. We do not control model outputs. AI outputs may be wrong, incomplete, or outdated. You must verify before acting. You approve all merges, deploys, spends, sends, publishes, and production changes.
Kits provide operations templates and drafting aids only. They are not legal, tax, accounting, medical, financial, investment, insurance, employment, immigration, or other professional advice. Confidential / HR / incident modules are process framing only — lawful use required. Consult qualified professionals for your situation.
THE KIT IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING. WE DO NOT WARRANT RESULTS, REVENUE, UPTIME, SECURITY OUTCOMES, OR ACCURACY OF AI OUTPUTS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPERATOR FUEL AND JAMES BRUCHEY WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE KIT OR THESE TERMS WILL NOT EXCEED THE FEES YOU PAID TO US FOR THE SPECIFIC KIT GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (OR THE MINIMUM REQUIRED BY LAW IF GREATER RESTRICTION IS PROHIBITED).
You will defend, indemnify, and hold harmless Operator Fuel and James Bruchey from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from: (a) your use of the Kit; (b) your use with clients, employer, employees, or production systems; (c) your violation of these Terms or law; (d) content you generate or send using the Kit.
All sales are final. NO REFUNDS. This is a digital kit. Delivery begins when the zip is made available for download and/or emailed to you. Once delivery begins, you are not entitled to a refund, exchange, or credit, except where a refund is required by non-waivable law.
Honesty about chargebacks: Card networks and payment processors may still allow disputes/chargebacks under their rules. These Terms cannot waive rights that card networks grant cardholders. Filing a chargeback after download without first contacting support@getoperatorfuel.com may result in license termination and may be contested with delivery evidence. Contact support first if something is wrong with the file.
We do not offer a 14-day (or other) “try then refund” window on digital kit downloads.
We may terminate the license if you breach these Terms. On termination you must stop using the Kit and destroy copies in your control. Sections on IP, disclaimers, liability, indemnity, and governing law survive.
These Terms are governed by the laws of the State of Michigan, United States, without regard to conflict-of-law rules. Courts in Michigan shall have exclusive jurisdiction, except where prohibited. Confirm with counsel before relying on this venue clause.
We may update these Terms by posting a new version on getoperatorfuel.com. Continued use after posting constitutes acceptance where permitted by law.
These Terms plus the applicable product listing and kit DISCLAIMERS.md are the entire agreement for the Kit. If a provision is unenforceable, the rest remains in effect.
By purchasing, downloading, installing, or typing I agree in the installer, you acknowledge you have read TERMS.md and DISCLAIMERS.md and agree to be bound.
